Expressions of Liberty

A commentary on the governmental respect for natural human rights as expressed by the founders of the United States and how it effects us today. I also show how the Declaration of Independence and the United States Constitution and other related documents are not dead documents in America today, but merely ignored and misused.

The Right Action, The Wrong Government In A State V Federal Government

The Federal government proposes mandatory testing for HIV/Aids in hopes of slowing down the disease and prolonging the life’s of those who have it. 4000 individuals die from Aids in the United States every year and the rest are kept alive by high cost medicine that is sometime picked up at the taxpayers expense. Since 40,000 new cases are reported annually it is a net of 36000 or +.012% of the total U.S. population.

50% of the known cases are homosexuals and 87% of the confirmed cases are in males. This sticks with the transmission factor I heard of that sodomy, intervenes drug use, blood transfusion, and birth to a HIV/Aids infected mother. Researchers claim that there is an increase in infections by vaginal intercourse but I have my doubts because almost all cases I hear of are of a bisexual male infecting a heterosexual female and there is male female sodomy as well as vaginal intercourse. If vaginal intercourse is a large factor then HIV/Aids has increased in threat level.

According to the CIA fact book 6% of the population has HIV/Aids and half of those with HIV/Aids are homosexuals. If this is correct and the 2-4% estimate of the percent of our population who is actively homosexual is also correct then the vast majority of homosexuals have HIV/Aids and it does not have much further to spread.

It is a myth that condoms stop HIV/Aids as they do not stop pregnancies. Going by their success at stopping pregnancy you would have a 1/5th to 1/6th of the chance of catching HIV/Aids that you would have with out them. Every time you have sex you are gambling with your life and your health.

Our government should have acted against HIV/Aids long ago by setting up colonies for infected individuals and segregating jails. Their failure to do this because of political correctness has allowed the disease to spread to a point where colonies are no longer a viable option. The segregation of jails should be done in every state.

This lack of segregation explains why HIV/Aids is spreading in the Black community. Many individuals practice sodomy in jail and a higher percentage of Blacks are imprisoned than whites. When these men exit jail have sex with women of their own choice and mixed racial couples seem to be rare in our society.

Abstinence until marriage and faithfulness in marriage are the best ways to avoid any kind of sexually transmitted disease providing you do not marry a person that is STD positive or a person who is unfaithful to you.

By the Ninth Amendment of the U.S. Constitution the federal government does not have the authority to actually legislate mandatory tests within the jurisdiction of the states. They will of course ignore that detail as they have for many years. The states are quite capable of acting to protect the general welfare of their own people but the federal government likes the unconstitutional power rush.

Source 1 is article about mandatory HIV testing and has a story where a bisexual male infected a heterosexual female.

Source 2 is abstract about heterosexual transmission of HIV-1 where a bisexual male infected a heterosexual female.

I am posting a correction to this blog. The HIV/Aids rate is .6% or 950 thousand individuals and the deaths each year from Aids is 14,000 individuals. I am sorry for my errors. I am not sure how the CIA factbook got these figures but I did notice that the 950,000 and .6% did not match with the 298 million population. Maybe it is another failure of intelligence from the CIA.

Kerwin,

That was one of the most ill informed and pathetically homophobic diatribes I've read in a long time.

"It is a myth that condoms stop HIV/Aids as they do not stop pregnancies."

Condoms worthless? Where do you fundies get this crap?

"Epidemiologic studies that are conducted in real-life settings, where one partner is infected with HIV and the other partner is not, demonstrate conclusively that the consistent use of latex condoms provides a high degree of protection."

http://www.cdc.gov/nchstp/od/latex.htm

"Abstinence until marriage and faithfulness in marriage are the best ways to avoid any kind of sexually transmitted disease"

But god forbid a gay couple wanting to have such a committed monogamous relationship!

And your suggestions for leper colonies for AIDs sufferers is not only stupid, it is just plain hateful.

Do you actually know any gay people?

Cranky,

From what I have seen HIV-1 is sexually spread mainly through sodomy. According the CDC link you provided the studies focused on couple having penile-vaginal intercourse. It would be a fallacy to assume the HIV-1 rate of condom users who collaborating in sodomy is the same as that of those cooperating in penile-vaginal intercourse. It also reports inconsistent results though theoretically latex condoms filter out the virus. I felt justified in my previous assumption that they are somewhat effective in reducing the spread as there is evidence that the increase of condom use in a population corresponds to the decrease in sexual transmitted diseases.

If homosexuals can practice abstinence then it makes homosexuality a choice which is something that the homosexual movement denies is the case. If they can not practice abstinence it becomes an addiction which is also something the homosexual movement denies. From what I know those are the only two choices. If two individuals choose to engage in sex of any kind they can be sexually loyal to each other whether or not the government sanctions their marriage.

Why do you believe leper colonies are hateful. They are based on the medical practice of isolation as a preventative to the spread of disease but allow people to have a normal life except for the travel restrictions.

Highboy,

This is the politically correct way to say the same thing and comes from the CDC link cranky provided.

“The surest way to avoid transmission of sexually transmitted diseases is to abstain from sexual intercourse, or to be in a long-term mutually monogamous relationship with a partner who has been tested and you know is uninfected.”

"Why do you believe leper colonies are hateful."

Are you truly that insesitive and ignorant?

First and formost, HIV infectied individuals pose no threat to you or I. Unless of course you are planning to have unprotected anal sex any time soon. Why do they have to be moved to a government subsidized camp (like this could even happen, except in your totalitarian dream world) just to asuage your homophobia?

You want to tell Magic Johnson to move to a ghetto for your peace of mind? I'd pay to see that.

"If homosexuals can practice abstinence then it makes homosexuality a choice which is something that the homosexual movement denies is the case. If they can not practice abstinence it becomes an addiction which is also something the homosexual movement denies. From what I know those are the only two choices."

Substitute heterosexuality into your statement. Just idiotic, no?

By the way, again, do you know any gay people?

It is irrelevant if HIV sufferers present a threat to me personally. What is relevant is they present a threat to the general welfare of American people and 40,000 new cases a year is definitely a threat. Those people are human beings whether or not they engage in sodomy.

Sodomy is only one way that HIV-1 is transferred to the victim. A colony keeps those with HIV/Aids separated from the general population and thus protect them while allowing the isolated community a normal life in every other way but travel. Only half the population of HIV/Aids sufferers are homosexual so your accusation of homophobia is deeply flawed. The statement that all leper colonies are ghettos is certainly untrue as HIV/Aids does not prevent people from working. HIV/Aids is already government subsidized.

The theory is that heterosexuals can also practice abstinence which makes it a choice and if they can not then they have addiction which is called a sex addiction. Heterosexuals can also engage in homosexual sex and vice versa.

At 6% of the population being infected the option of isolation is no long a viable choice except if people voluntarily self isolate themselves and that is not working.

"a normal life in every other way but travel"

What's frightening, is I think you're serious.

"The statement that all leper colonies are ghettos is certainly untrue as HIV/Aids does not prevent people from working."

I'm sure this "colony" of yours will be diverse enough to represent all the careers, industries, entertainment etc. available to the "normal" population. Or is this just a place for "those people" to return to each evening?

Those with HIV/Aids are abnormal in regards to have having HIV/Aids since only six percent of the population have that particular disease. I am certainly glad they are not normal as we would be as bad off as what I hear Africa is.

Form what I know HIV/Aids sufferers are of a wide variety of careers, industries, entertainment, etc. I could be wrong, but human beings are very adaptable. The goal is to prevent 40,000 more people getting terminally ill each year and 4000 dying. Cuba actually succeeded with a similar plan and their HIV/Aids rate is less than .1% or one sixtieth of ours.

"The goal is to prevent 40,000 more people getting terminally ill each year"

Yeah right. That's your goal. wink, wink.

But that aside, and first of all, contracting the virus is no longer a death sentence. (Perhaps you are still living in the 80's, though your thinking looks more like 30's Germany). Anti viral drugs can keep the virus at bay, and reduce it to almost undetectable levels. There are advances toward a vaccine for HIV, clinical trials for which I believe are already taking place.

"I could be wrong, but human beings are very adaptable."

Adaptable to what? You are proposing taking 1.5 million people, many of whom are healthy, intelligent, some wealthy, taxpayers and force them into a "colony" consisting of what?

Oh, and again, do you actually know any gay people? I find most people with a fear of the "other" usually don't actually know any "others".

Cranky,

You are obviously incorrect as 4000 people dying of Aids testify that it is still a death sentence for some thought life can be prolonged with the treatments that have been developed since the 1980’s.

The treatment are expensive and often paid for by the citizens tax dollar which means that either taxes have to be raised to compensate for the growing cost or the cost gets added to the federal deficit. According to an University of Alabama study at Birmingham the cost for each patient is from $14,000 to $34,000 dollars a year. According to the CIA Fact book 6% of our population or about 18 million people have HIV/Aids which means that if we played for treating them all we pay from 252 billion to 612 billion dollars on treating HIV/Aids each year. It is quite to boost for the Health Industry at the expense of the people. Then since the epidemic is growing by 36,000 people a year you have and additional 504 million to 1,224 million dollars added on each years. This is but one preventable cost and you wonder why we have high taxes and a deficit at the same time. There is a third option that I did not mention above which is favored by libertarians and that is for the government not to pay for HIV/Aids medicine. I am opposed to it but you may support it.

At 18 million people the epidemic has far surpassed the point where isolation is an option. The best that the government can do now is make it mandatory that people with HIV/Aids carry some type of indication they have HIV/Aids so their victims have more chance of defending themselves. People adapt to the jobs that are available. Part of the reason you pay the government tax money is so they will “promote the general welfare” which can be the result of a more assertive stance against the HIV/Aids epidemic.
